The three Learning Outcomes
- 01Understand the legal issues in the formation of contracts
- 02Understand specifications and key performance indicators in contracts
- 03Understand the key clauses in formal contracts
A sample question, in the course style
A procurement manager needs to invite multiple suppliers to submit detailed proposals, including methodology, staffing plans and pricing, for a complex facilities management contract. Which document type is most appropriate?
- AA request for quotation, which collects comparable price submissions against a fixed specification
- BA purchase order, which formalises an agreed transaction and instructs a supplier to deliver
- CAn invitation to tender, which requests comprehensive proposals covering methodology, resourcing and pricing
- DA non-disclosure agreement, which governs the confidentiality of commercially sensitive information
An invitation to tender is used for complex requirements where buyers need to evaluate suppliers on methodology, resourcing and pricing together, not price alone.
Why the others do not fit. A request for quotation suits simpler, well-specified requirements where price comparison is the main need. A purchase order is issued after selection to confirm the contract. A non-disclosure agreement governs confidentiality, not the soliciting of proposals.
